Terms of Service

Effective date: January 1, 2024

Please read these Terms of Service carefully before engaging with DevChyf Technologies. By using our services you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the services provided by DevChyf Technologies ("DevChyf", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, clients, and users of our website and services.

2. Services

DevChyf Technologies provides software development services including but not limited to: mobile application development, web application development, website design, custom software development, AI & automation solutions, fintech & USSD development, UI/UX design, cloud solutions, tech consultation, and ongoing maintenance & support. The scope of services for each engagement is defined in a separate Statement of Work or project agreement signed by both parties.

3. Client Responsibilities

Clients are responsible for providing accurate project requirements, timely feedback, and necessary assets or credentials required for project delivery. Delays caused by lack of client response or incomplete information may affect project timelines. Clients must ensure they have the legal right to use any content, trademarks, or intellectual property provided to DevChyf for use in their project.

4. Payment Terms

Payment terms are agreed upon in the project contract or invoice. Unless otherwise stated, a deposit is required before work commences, with the remaining balance due upon project completion or at agreed milestones. Late payments may result in suspension of services. All fees are non-refundable unless otherwise stated in writing.

5. Intellectual Property

Upon receipt of full payment, clients receive full ownership of the deliverables created specifically for their project. DevChyf retains the right to display completed work in its portfolio unless the client requests otherwise in writing. DevChyf retains ownership of any pre-existing tools, frameworks, libraries, or general-purpose code used in the development process.

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the engagement. DevChyf will not disclose client business information, data, or project details to third parties without prior written consent, except where required by law.

7. Warranty & Support

DevChyf warrants that deliverables will function as specified in the agreed project scope at the time of delivery. A standard post-launch support period of 30 days is included unless otherwise specified. Issues arising from client modifications, third-party service changes, or misuse are not covered under warranty.

8. Limitation of Liability

DevChyf Technologies shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability to any client shall not exceed the total amount paid by that client for the specific service in question.

9. Termination

Either party may terminate a project engagement with written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. DevChyf will deliver all completed work to the client upon receipt of final payment.

10. Governing Law

These Terms of Service are governed by the laws of the Republic of Ghana. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if unresolved, through the appropriate courts in Accra, Ghana.

11. Changes to Terms

DevChyf Technologies reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised terms.
